MidAtlantic’s Environmental Department provides excellent client support in a number of different ways, including using our significant regulatory knowledge to advocate for their interests.
MidAtlantic recently assisted the owner of an auto body shop after it was discovered that their property was the subject of an NJDEP Regulated UST and Spill Act Discharge case for petroleum contamination. This case, which predated our client’s ownership, was subject to NJDEP compulsory direct oversight due to missed investigation and remediation mandatory timeframes. As a result, our client faced significant financial consequences including direct oversight fees and penalties, as well as the challenge of adhering to additional administrative and reporting requirements beyond those typically required.
Our team of LSRPs and scientists conducted a detailed review of the case and determined that the case had been incorrectly assigned by NJDEP as a regulatory UST case. MidAtlantic presented our understanding of the project history to the NJDEP and was able to successfully have the case reassigned to the Unregulated Heating Oil Tank (UHOT) program and moved out of direct oversight, thereby saving a significant amount in penalties, time, and effort for our client.
